Labor & Employment Law
Macfarlane
Ferguson & McMullen's
attorneys engaged in a labor and employment law practice have extensive
experience in representing employers in all aspects of labor and
employment law. Their work includes representing employers charged with
race, age, national origin, religious, marital status and disability
discrimination and sexual harassment, litigating all types of employment
disputes, and advising employers on the labor law implications of business
decisions, including mergers, acquisitions, workplace reductions and plant
relocations and shut downs.
The firm’s attorneys stress preventive labor and employment relations and
regularly counsel employers on all aspects of labor and employment law,
including confidentiality and non-competition agreements, drug testing,
family leave, affirmative action, plant closings, workplace violence,
unions, and wage and hour issues, as well as compliance with new
developments in the law. They have extensive experience in representing
employers in administrative proceedings before the Equal Employment
Opportunity Commission, the National Labor Relations Board, the Florida
Commission on Human Relations, the Public Employees Relations Commission,
the Occupational Safety and Health Administration, the Department of Labor
and the Immigration and Naturalization Service.
These attorneys have negotiated numerous collective
bargaining agreements with a wide variety of labor organizations in both
the private and public sectors, often achieving significant economic
relief for employers who have union contracts. Their experience includes
arbitrating discharge and contract interpretation cases, as well as
representing public employers in special master proceedings. They also
have assisted a number of employers in successfully resisting efforts to
unionize their workforce.
The clients represented by this group cover a wide
spectrum of industries, including heavy and light manufacturing, banking,
brokerage, insurance, utilities, newspapers, entertainment, retail,
contracting, freight and transportation, health care, agriculture, travel
and entertainment, food, and real estate development and management. In
addition, the group represents a number of governmental units, trade and
not-for-profit associations, religious institutions and diversified
service firms.
