Andy Bolin was selected
by the Florida Defense Lawyers Association (FDLA) to co-author an
amicus curiae brief with FDLA President, Gail Leverett Parenti in
Florida Hospital Waterman, Inc. v. Buster, in support of the
hospital. The brief addresses issues involving the recently enacted
Amendment 7 to the Florida Constitution (“Patient’s Right to Know”)
in discovery in medical malpractice litigation and is available for
viewing here.
Andrew M. Brown and Andrew S. Bolin obtained a complete defense verdict on behalf of their client after a one week wrongful death medical malpractice trial in Citrus County, Florida. The Plaintiffs alleged that an emergency room physician was negligent in his decision to discharge a patient who presented complaining of chest pain radiating into the left arm and neck. Mr. Brown and Mr. Bolin argued that the physician's examination met the standard of care and that the physician could rely on the multiple cardiac test results, which were normal, to make his decision to discharge the patient for follow up care on an outpatient basis. The Plaintiff's demand in the case was $2.5 million dollars.
